Health Department says stay out of the water at some Southwest Florida beaches

CHARLOTTE COUNTY, Fla.- It may be beautiful weather at the beach, but you may need to steer clear of the water in some areas this weekend.

The Charlotte County health department? is issuing a swimming advisory for a number of Southwest Florida beaches, after recent water samples revealed a dirty dilemma.

For James Williams and family, a vacation to enjoy Southwest Florida beaches isn’t quite panning out as planned. Swimming advisories are now in affect at a handful of Charlotte County beaches, thanks to unusually high levels of two different types of bacteria.

“It’s a shame for the kids, but if it happens, it happens,” Williams said Saturday.

The bacteria traces back to human and animal fecal matter. It’s washing up at beaches in Englewood, Palm Island, Port Charlotte and Boca Grande.

“I’ll go home and play with a hose before I get in there, you couldn’t pay me to get in there,” Williams said.

Health department officials say the surge in bacteria is likely linked to the recent heavy rainfall. Either way, many beach go-ers are being forced to take in the scene from a distance.

“I won’t even touch it, I won’t even walk my feet in there. I don’t want that stuff on me,” said Jeff Vincent, who was surprised by the signs during his visit to Port Charlotte beach on Saturday.

Still, some are ignoring the yellow warning signs lining the shore at Port Charlotte beach. They say they’re taking their chances, in an effort to cool off from the summer sun.

“Nine times out of ten, not everybody’s going to get sick from it. We just went in and had fun. Spent a few minutes in, few minutes out,” said Rllan Wood, who took to the water despite the warnings.

The health department says normally, Mother Nature clears up the problem within one to two weeks. In the meantime, some swimmers just learning of the advisory say they’re taking a break from the beach.

“That’s disgusting. Ok, I don’t think I’m going again then,” said Zach Davenport, after learning about the water sample results.

Scientists examine Gulf’s uncertain post-spill future

SARASOTA, Fla. – Scientists at Mote Marine Laboratory in Sarasota have been studying the aftermath of the oil spill ever since the Deepwater Horizon rig blast.

Wednesday night, several of those scientists talked about what they’ve learned so far, and how it could help answer the many questions that lie ahead.

“Its very weather-driven, very tide-driven,” said Dr. Barbara Kirkpatrick, who studies beach conditions.? She notes Southwest Florida beaches are clean, but areas of the panhandle have been different.? “They get more impacts at high tide than low tide.”

Research originally designed to study things like red tide now look for the impact of oil.? An underwater robot has regularly scanned the Gulf waters off Southwest Florida.

“The major thing we found is we don’t have any oil,” said Dr. Gary Kirkpatrick.

Its been good news so far for Southwest Florida, but its also relatively early in the gulf’s recovery…

“The surface is being cleaned up and looking a lot better, but we know there is a lot more oil below the surface out in the Gulf,” said Dr. Gary Kirkpatrick.

While scientists can look at past spills for guidance– like the Exxon Valdez in Alaska– the Gulf of Mexico is a very different ecosystem, where only time will tell.

“Although the lessons from the Exxon Valdez help in how we address some of these things, the knowledge of the Gulf of Mexico scientists have from what the Gulf was before is going to be important,” said Mote Marine president Dr. Kumar Mahadevan.

Scientists at a panel discussion Wednesday say that long-term impact may be subtle, but could be significant, not only for wildlife, but for the economy, environmental and health of the Gulf Coast.

“What impact does it have on our natural resources, our fisheries, all the things we depend on,” Dr. Mahadevan said.

Mote marine has been doing all of this research largely off donations. They hope to get additional funding from BP and the government as their research goes forward.

Mote Marine has also been monitoring beach conditions along the Gulf Coast, including Southwest Florida.

Lawsuit: Doctors paid to refer Medicare patients

NAPLES, Fla. (AP) – A former southwest Florida hospital executive is accusing a health operator of paying doctors to refer Medicare patients to the company’s hospitals.

A lawsuit filed by Michael Mastej claims that Health Management Associates also offered free rent and private jet trips to entice doctors. The lawsuit filed in January was unsealed recently in Tampa federal court.

A telephone message left for HMA and the state attorney’s office weren’t immediately returned.

Health News Florida reports that Mastej, a former resident of Bonita Springs in Lee County, now lives in Blairsville, Ga.

The lawsuit does not specify the number of claims, but says the alleged fraud started in 2007. The company operates approximately 56 hospitals in 15 states.

“He was a fairly hands-on CEO,” said John Schilling, a former reimbursement supervisor in the Fort Myers division office. “He should have known being CEO of a multibillion-dollar company. He should have known what is on his balance sheet.”

“You’re over-lawyering this,” Nashville attorney Jerre Frazier recalled Scott telling him. “He’s an optimistic kind of guy. He doesn’t like bad news.”

A whistleblower in the Columbia/HCA fraud case said Rick Scott should have known of billing practices at his hospitals that cheated the federal government out of millions of dollars.

“He was a fairly hands-on CEO,” said John Schilling, a former reimbursement supervisor in the Fort Myers division office. “He should have known being CEO of a multibillion-dollar company. He should have known what is on his balance sheet.”

A Nashville attorney brought in for his auditing acumen remembers talking to Scott about significant compliance problems.

“You’re over-lawyering this,” Jerre Frazier recalled Scott telling him. “He’s an optimistic kind of guy. He doesn’t like bad news.”

These former corporate insiders are bewildered by Scott’s candidacy for Florida governor, let alone his dramatic rise in the polls.

Voters are seemingly discounting Scott’s forced resignation in 1997 shortly after the FBI began widespread raids of Columbia/HCA offices. Ultimately, the largest for-profit hospital chain in the United States paid a record $1.7 billion in criminal and civil fines for Medicare fraud.

In television ads and on the campaign trail, Scott has repeatedly said he takes responsibility for what happened at the company and says he learned from it.

“Initially when I first saw he was running, I didn’t give him much chance,” said Schilling, 48, who has lived in Naples since 2001. “You can buy your way into the candidacy.”

Schilling didn’t know Scott also lives in Naples until he began research for his 2006 book, Undercover, detailing his life as an FBI informant in the case. The two have never run into each other in Naples.

“He’s putting on what people want to hear,” Schilling said of Scott’s candidacy. “People are always frustrated at inefficiency of government.”

Schilling was hired at the company’s Southwest Florida division offices in 1993 as a reimbursement manager. Six months into the job, he sensed something was wrong. A Medicare auditor had made an error that resulted in a $3 million gain at Fawcett Memorial Hospital in Port Charlotte.

District executives conspired to keep the mistake under wraps and keep the ill-gotten gain. He soon found other record irregularities going back at least 10 years.

“I exposed a double set of books,” he said, adding that one set was inflated cost reports for the federal government and the second was for internal purposes.

“The second was stamped confidential and don’t show to Medicare auditors,” Schilling said. “We estimated alone in 10 years over a billion in overpayments to the chain.”

In time, Schilling joined forces with James Alderson, an accountant at a Montana hospital, in a whistleblower case against Columbia/HCA.

Scott’s way of doing business was to have his chief executive officers at regional offices play hardball with acquisitions of other hospitals, doctors’ practices and bottom-line profits.

“If you didn’t cut the mustard, you were let go, if you didn’t meet budget goals,” Schilling said. “That is the way Rick Scott ran the company. He gave goals on notecards. He created a culture that the individual pushed the limit. Bonuses were 50 percent or more of a salary.”

Frazier, the Nashville attorney brought in to troubleshoot compliance issues, recalls Scott as always polite and personable.

“He was not a tyrant,” said Frazier, who now lives in Houston. “He stood in line in the cafeteria.”

The same day he was ousted as CEO, Scott didn’t flee the corporate premises _ instead he shook hands with employees.

“There were three buildings and he went around and expressed his appreciation to people,” he said.

Scott’s downfall nonetheless was the corporate culture he created that went bad, Frazier said, explaining that hospital managers and division chiefs were relentless in meeting Scott’s mission of creating a unified health-care and hospital company.

“I did not see Rick Scott act in bad faith but what I did see is the corporate culture he presided over. I did not see Rick Scott to be inclined to do anything criminal,” he said.

Still, Frazier isn’t certain how aware Scott was of the consequences of the corporate culture he created.

“I’m not sure he understood how much his lieutenants twisted arms,” he said. “People did not report bad news to him.”

Bill McCollum, may be truthful that impoverished seniors and uninsured pregnant women who were unable to pay were turned away at Columbia/HCA hospitals. But he doesn’t believe that would have happened if Scott were on the scene.

“I don’t think Rick Scott would have left someone outside, I don’t think he would have left someone to die,” Frazier said. “That is not the right thing to do and I do think he would have said it was not the right thing.”

Still, bottom-line driven hospital managers with sights sets on their bonuses were more than likely to find ways to exclude services to the poor and uninsured.

“Turn people away? It may have been a little more extreme at HCA,” he said.

Schilling, the Southwest Florida whistleblower, said he’s certain those kinds of things happened at Columbia/HCA and other hospitals.

“What I did hear sometimes in the trenches, some cost-cutting measures did have impacts on the quality and nurses were stretched thin. Patient satisfaction (surveys) showed high results. Who is compiling those surveys and how valid are those? Was there an independent source?”

For certain, when the federal investigation went into overdrive, a mountain of lawyers was retained, Frazier said.

“Three law firms were hired, each undermining each other. There was sort of mass confusion,” he said. “The lawyers did have control over who had access to Rick Scott.”

“CEOs blanket themselves with attorneys,” Schilling said. “They dodge the bullet of not being questioned. He never gave any information or assisted in the investigation.”

Although Scott has stated that he takes responsibility, Schilling doesn’t think that should satisfy voters.

“I give him credit for taking responsibility for those things but again, he stated he wasn’t aware of the fraud,” Schilling said. “I find it somewhat ironic, here you have someone running a multibillion-dollar company and he is not aware of what is going on and yet he wants to be governor. Is he going to not be aware of what is going on in state government? I just wouldn’t trust him.

“It must be an ego thing,” he added, about his theory of why Scott is running for governor. “He must need the ego of being in charge. I don’t know. It’s not for the money so it’s got to be for the ego.”

Man suffers serious injuries at San Carlos Park work site

A worker was seriously injured during a construction accident about 11:30 a.m. Wednesday, officials said.

It occurred in the 19000 block of La Serena Drive in the Belle Lago gated community, authorities said.

The man was not transported from the site to a hospital. Occupational Safety and Health Administration officials have been called to the work site to investigate, said John Sheehan, a Lee County sheriff’s spokesman.

Naples Home Builders Having a Hard Time with Chinese Drywall Problems

Home builders are having a difficult enough time as it is with the economic crisis and poor housing market. To then be faced with problems in work you have done, as well as trying to find work to do is a bit much.

This is the problem facing many Florida based construction firms because of defective imported drywall. During the housing boom of 2004/5 builders where busier than ever, as was the rest of the construction industry. This, combined with several hurricanes, including Katrina resulted in an unprecedented workload for construction companies. It also led to a shortfall in building materials as local producers struggles to keep up.

Many firms had to turn to imported materials in order to maintain momentum, and this is where the problems started. Drywall imported from China was used in thousands of properties across Florida, Louisiana and Alabama. Nothing was thought of it at the time, as construction firms were getting a steady supply of cheaper material, and the industry at large was given a breath as the shortage subsided.

It was only later, once the properties were constructed, and lived in for a while that problems began appearing. A smell like rotten eggs was soon being experienced by homeowners. Then came mysterious illnesses, without an obvious cause. Symptoms such as breathing difficulties, headaches, ear infections, eye irritations, and many other began appearing in households.

Eventually investigations led to the drywall, which in turn led to the imported drywall. It was found that it contained hydrogen sulfide among other things which gives off the rotten egg type smell. It is also attributed to various health issues, including the ones being experienced by homeowners. There are solutions for home owners who need to replace or repair the tainted drywall. Unfortunately it is a very costly process as all of the drywall usually needs to be ripped out and replaced with standard American drywall. Some of the companies offering this service are Chinese Drywall, China Drywall, and China Drywall Fixers.

Not only was this gas the cause of the smell, and allegedly the root of the health problems, it is also corrosive. Investigations into some of the affected homes found that it had corroded wiring, air conditioning and even new appliances. Copper is especially prone to corrosion and forms parts of many domestic appliances like washers and dryers. Studies found that in some cases, new appliances had experience catastrophic breakdown of the copper pipes causing them to fail.

The internal wiring of homes is also believed to be at risk as those that have been checked show signs of significant damage. In some cases the whole property has had to be completely rewired. Damage varies, depending on the extent of the work needed, and how much imported drywall was used. The material was used extensively in Florida over the period, perhaps in as many as one hundred thousand homes.

The true scale of the financial impact is as yet unknown. Beleaguered construction companies could do without the suits and claims being made against them as they fight to survive, Class-action suits are being launched by construction firms against the suppliers of the materials in turn in order to recoup losses.
Whatever the true scale of this issue, we have only seen the beginning of it.

The International Association of Athletics Federations is expected to disqualify the South African from future events and advise her to have surgery because her condition carries grave health risks, The Daily Telegraph reports.

And she could be stripped of the gold medal she won in Berlin in last month.

Semenya has three times more testosterone than a normal female.

A source closely involved with the IAAF tests said Semenya had internal testes – the male sexual organs which produce testosterone.

Testosterone is a male hormone with a primary task of building muscle bulk. It also produces body hair and a deep voice.

It is believed Semenya is unaware the tests identify her as an hermaphrodite.

Only the certainty of a savage backlash from South Africa has so far prevented the IAAF from banning Semenya and revoking her gold medal.

South Africa embraced the feisty teenager after the storm of controversy from Berlin, declaring her “Our girl”.

African National Congress MP and National Assembly sports committee chairman Butana Komphela has already lodged a complaint with the United Nations High Commission on Human Rights, accusing the IAAF of racism and sexism.

Speaking on condition of anonymity, a source explained the political and personal sensitivities involved.

“There certainly is evidence Semenya is a hermaphrodite. But the trouble is the IAAF now have the whole ANC and the whole of South Africa on their backs. Everything is going to have to be done absolutely by the book, no question of a challenge to the findings.

“There’s all sorts of scans you do. This is why it’s complicated. In the past you used to do a gynaecological exam, blood test, chromosome test, whatever. That’s why they (the findings) were challenged, because it’s not quite so simple.

“So what they do now is they do everything, and then they can say, look – not only has she got this, she’s got that and the other.

“The problem for us is to avoid it being an issue now which is very personal – of the organs being a hermaphrodite, of not being a ‘real’ woman. It’s very dramatic.”

The IAAF expects to receive the full set of results this week.

When quizzed last week by magazine You, Semenya said: “I see it all as a joke, it doesn’t upset me. God made me the way I am and I accept myself. I am who I am and I’m proud of myself. I don’t want to talk about the tests. I’m not even thinking about them.”

While the IAAF is treating the Semenya case as a health matter, the same South African politicians who denied AIDS was a problem in their country are standing behind their queen of the athletics.

“Of course Caster is a totally innocent victim in this whole affair,” the source explained.

“What could she do about it? And the IAAF accepted her entry. So the two parties at fault are the IAAF and especially Athletics SA.”
