Home costs within the Denver region had been down 0.1 % in July from a year earlier, according towards the newest S&P/Case-Shiller Home Costs Index, released Tuesday.

It was the first time since last October that the closely-watched monthly Case-Shiller report from Standard & Poor’s failed to show a year-over-year increase in Denver-home home costs.

The area’s costs declined 0.4 % in July from the previous month, the first month-over-month decline since February and the third largest drop of the 20 cities tracked by the Case-Shiller index.

Denver was one of 10 U.S. cities out of the 20 to show a year-over-year price drop in July, and one of seven to see a month-to-month decline.

The average price change for the 20 cities was a 3.2 % increase in July from a year earlier, and a 0.6 % rise from the month before.

David M. Blitzer, chairman of the Index Committee at Standard & Poor’s, said that the data showed a weakening in home-price growth in most cities.

“While we could still see some residual support from the [federal] homebuyers’ tax credit, which covers purchases closing through Sept. 30, anyone looking for home price to return towards the lofty 2005-2006 might be disappointed,” Blitzer said in a statement. “Judging from the recent behavior of the housing market, stable costs seem more likely.”

Denver saw year-over-year price increases of 1.8 % in June, 3.6 % in May, 4.4 % increase in April, 4.1 % in March, 3.6 % in February, 2.6 % in January, 1.2 % in December 2009 and 0.5 % in November 2009.

November 2009’s rise was the first year-over-year home price increase within the Denver region since November 2006, based on a Denver Business Journal analysis of Case-Shiller data. Between those months, Denver had 36 straight months of year-over-year price declines.

As recently as early 2009, Denver was showing year-over-year home price declines of 5 % or more, peaking at a 5.7 % drop in February 2009 from a year earlier.

As far as month-to-month price changes, Denver saw a 0.7 % home price rise in June over the previous month, 0.6 % price increase in May, a 1.7 % monthly gain in April and a 0.6 % rise in March. Before that, Denver experienced month-to-month price declines every month between September 2009 and February 2010.

The report assigns index values towards the 20 cities based on current average home costs in relation to what they had been in January 2000.

Denver’s index for July was 128.72, meaning that costs had been 28.72 % higher than they had been in January 2000. The 20-city average index was 148.91 for June.

Denver ranked 11th among the 20 cities within the July report in its rate of home-price change over the previous year, with first meaning the city with the most growth in costs.

San Francisco saw the biggest year-over-year price increase in July of the 20 cities: 11.2 %. It was followed by San Diego, up 9.3 %, and Los Angeles, up 7.5 %.

On the other hand, costs in Las Vegas dropped 4.9 % in July from a year earlier, while Charlotte saw a 3.5 % decline and Tampa a 3.2 % drop.

As for month-to-month price changes, Detroit saw the greatest price rise in July, of 1.6 %, followed by New York, up 1.3 %, and Washington, up 1.1 %. On the other hand, Las Vegas costs fell 0.8 % from the month before, while Phoenix costs had been down 0.6 %.

The Case-Shiller index is compiled by comparing matched-price pairs for thousands of single-family homes in each market. Standard & Poor’s and Fiserv Inc. publish it.

Samir Cabrera back in Lee County

LEE COUNTY, Fla. – A convicted Southwest Florida real estate agent is back home after spending the last year in prison. Samir Cabrera was released yesterday as he awaits appeal.

Friday, a US. District Court Judge reinstated Cabrera’s $100,000 signature bond. For now, he’s a free man, home with family, and awaiting his ultimate fate, a decision that could take some time.

As part of his bond, a judge ordered him to live with his father in South Fort Myers. He had little to say, but his aunt told us he’s happy to be back.

Cabrera was convicted in January of 2009 of wire fraud and money laundering after ripping off investors in Lee County land deals on Fiddlesticks Boulevard. It cost them $2.8 million. Cabrera was later sentenced to ten years in prison.

But he was released only one year into that sentence after the Supreme Court narrowed the honest services fraud law under which Cabrera was convicted to the point it no longer applied to him.

Federal prosecutors say the convicted real estate agent should get a new trial. The defense disagrees.

If the court decides against a new trial, then Cabrera is a free man. If they decide for a new trial, he goes back before a judge. While in theory, the court could still uphold the conviction, the government conceded those convictions can’t stand.

Cabrera’s attorney Russell Rosenthal said a final decision may not come until next year.

Real estate agents hounding BP for compensation for losses

WASHINGTON (AP) – The administrator of a $20 billion oil spill compensation fund said Wednesday he’s been besieged by real estate
agents and brokers, demanding that they become eligible for payments.

Kenneth Feinberg, in congressional testimony singled out the real estate agents’ demands as one of many tough eligibility decisions he’ll have to make in the coming weeks.

Feinberg told the House Judiciary Committee he’s working only for victims, not BP or the Obama administration. Operations of the independent fund will begin next month, starting with six-month
emergency checks that will be processed within a day and paid out within the next two days.

The emergency payments will not require a release from future claims. Long-term settlements – for current and future injury or loss – will require agreements to accept the offer as final payment. Victims can reject the money and pursue claims independently in court.

Feinberg said he’ll need to work out a system for those who develop illnesses from the cleanup years afterward.

Feinberg said he has heard from many real estate agents and brokers about their lost income, and promised to address their concerns.

“The Realtors and real estate brokers are a major political force,” he said. “I’m hearing from them constantly. I’m not sure whether they have a valid legal claim. I’m not sure they can win if they litigate.? “If I am going to do justice here, we’ve got to do something.”

In October 2007, Enzo Vincenzi, 43, now of Estero, paid Miriam Pacheco $50 and the “Santeria Africana” spiritual adviser and healer warned he was in grave danger. Pacheco, who calls herself Madrina Miriam (godmother Miriam), warned only she could help. In the end, Pacheco took Vincenzi to a Fort Myers lawyer, and Vincenzi signed documents that Pacheco prepared, signing away his motel.

“During the course of the ceremony, Pacheco killed a bird and passed it over Vincenzi’s stomach while praying and chanting, which she claimed would heal his stomach ailments,” the lawsuit says. “Pacheco also covered Vincenzi’s eyes, made him drink an unidentified liquid and laid her hands on him — all of which she claimed would help heal him.”

Attorney Joseph Hoffman, who represented Pacheco, just considers it a case involving a language barrier: Vincenzi speaks English, while Pacheco only speaks Spanish. “I’ve had weirder cases,” Hoffman said. “I’m not saying this was plain vanilla. But it’s a property dispute. That’s all it was.”


It sounds like a bad TV movie.

A sick Lee County hotelier worried about his finances and stomach problems looked in the Yellow Pages under herbs, found the Botanica 7 Potensias Africanas shop in Fort Myers, then sought treatment and help.

On that day in October 2007, Enzo Vincenzi, 43, now of Estero, paid the owner, Miriam Pacheco, $50 and the “Santeria Africana” spiritual adviser and healer warned he was in grave danger. Pacheco, who calls herself Madrina Miriam (godmother Miriam), warned only she could help.

Over weeks and months, there were ritualistic ceremonies involving a dead bird, a sacrificed rooster, liquid potions, prayers and chants by Pacheco, her Santerian “god-daughter,” Maria Teresa Torres, and another god-daughter.

In the end, Pacheco took Vincenzi to a Fort Myers lawyer, and Vincenzi signed documents that Pacheco prepared, signing away his motel.

Those are the allegations in a lawsuit Vincenzi and Sabal Oasis Inn filed in Lee Circuit Court against Pacheco, 57, and Torres, 43.

“It was a very bizarre case,” Naples attorney Michael D. Randolph, who filed a related lawsuit against Pacheco and Torres, said of Vincenzi’s allegations.

But attorney Joseph Hoffman, who represented Pacheco and Torres, just considers it a case involving a language barrier: Vincenzi speaks English, while Pacheco and Torres only speak Spanish.

“I’ve had weirder cases,” Hoffman said. “I’m not saying this was plain vanilla. But it’s a property dispute. That’s all it was.”

His clients have denied allegations of ritualistic ceremonies, fraud or coercing Vincenzi into turning over his motel.

On Thursday, Lee Circuit Judge Sherra Winesett signed an order for partial summary judgment, for $37,000 that a Lee circuit jury awarded Vincenzi in April for intentional infliction of emotional stress.

Vincenzi, who ended up marrying Torres’ daughter, was involuntarily committed to a psychiatric hospital under the state’s Baker Act months after the rituals, due to the loss of his motel and fears that Pacheco’s predictions of doom, his poisoning and death would come true.

His wife, Cynthia, testified against her mother and Pacheco, as did others who said Pacheco scammed them.

The jury also awarded Vincenzi $99,500 for the loss of his 13-room motel and attached home, finding fraudulent misrepresentation by Pacheco and Torres.

But Pacheco doesn’t have $99,000 and Vincenzi’s attorney, Bradley Lang of Naples, is working on a rescission of deed so Vincenzi can get his motel back.

“Returning the motel is ‘equitable relief’ and only the judge can do that,” Lang said after the brief hearing. “The jury can only award monetary damages.”

A rescission of deed is designed to make everyone involved whole, a domino effect that returns all parties back to the way each started.

In the other case, attorney Randolph has $250,000 that Pacheco obtained through a loan to pay his client, Leone Mason Contracting Inc., which is owned by Vincenzi’s father. He’d had the motel’s original mortgage, sued Pacheco and Torres for payment after the transfer, and they defaulted.

“If you have a car that you bought, you give it back to the dealer and the dealer gives it back to the manufacturer and the manufacturer gives it back to the smelter,” Randolph said, explaining a rescission. “You either choose damages or you choose rescission.”

Randolph would return the $250,000 to Pacheco, who would give it to her lender. Pacheco and Torres and their families would vacate the motel, then Vincenzi would get it back.

A hearing on the deed rescission hasn’t yet been scheduled.

“We’re waiting to see if my client can come up with the money,” Hoffman said. “Money is tight now.”

Vincenzi is hopeful.

“They made me homeless,” Vincenzi said after the hearing, adding that he’s unemployed and faces nearly $20,000 in medical bills. “They traumatized me, I ended up in the hospital, I’m drowning in debt — and they’re still in my house.”

Depositions show Pacheco, of Cuba, and Torres, who is from Honduras, have elementary school educations. They work at the motel and Pacheco’s store, which sells saint statues, candles, herbs for spiritual baths, and other items for spiritual ceremonies, voodoo and Palo, an Afro-Cuban religion also known as Reglas de Congo.

After the lawsuits were filed, there were allegations back and forth and restraining orders.

“They made up an incident report and three weeks later, when I was in court, they have me arrested and claim I assaulted them,” Vincenzi said. “The day we were supposed to go to trial on this, they dropped it. The judge warned them. He saw right through the whole thing.”

Torres, however, was convicted of battery on Vincenzi and resisting arrest after a Lee County deputy saw Torres hit Vincenzi.

Vincenzi also filed complaints to alert state and federal agencies about the real estate fraud. He’s reported the Fort Myers attorney who handled the deed transfer to The Florida Bar, two real estate brokers and an accountant to the Division of Business and Professional Regulation, and mailed letters to the state Attorney General, the U.S. Attorney, the FBI and others.

The original lawsuit filed by Vincenzi’s prior attorney, Andrew Epstein of Fort Myers, details the unusual case:

Pacheco cautioned Vincenzi he was in danger of demonic spirits, the devil, and said the hotel’s prior owners had buried the devil. He was in grave danger, faced IRS problems and she claimed prostitutes worked at his motel.

She said she could help by becoming his Santeria Africana godmother. At a card reading and St. Lazarus ritualistic ceremony, she warned he was a “walking dead man” and his housekeeper was poisoning his food.

“During the course of the ceremony, Pacheco killed a bird and passed it over Vincenzi’s stomach while praying and chanting, which she claimed would heal his stomach ailments,” the lawsuit says. “Pacheco also covered Vincenzi’s eyes, made him drink an unidentified liquid and laid her hands on him — all of which she claimed would help heal him.”

A week later, she sacrificed a rooster, saying it would protect him from the motel’s former owners, who were trying to kill him. She told him to pay her $500 so he could move into the home she shared with Torres. He remained there, confined to a bed, for about two months as she and Torres served as spiritual advisers.

She took him to a beach and performed a “Queen of the Seas” ceremony, chanting and praying over him as he lay in the sand. She urged him to see her attorney, who could help with legal problems she predicted.

She coerced him into transferring the property, promising to save him from demonic spirits and attempts on his life.

She took him to her attorney and Vincenzi signed deeds Pacheco prepared, transferring the motel to her and Torres without cost. He lost his Jaguar, pickup truck, motorboat and possessions after she evicted him; they deny taking his vehicles.

A former client used to picket Pacheco’s store, claiming she was defrauded, and evidence Lang obtained shows this wasn’t the only time Pacheco was accused of fraud.

An attorney for Devoe Pontiac in Bonita Springs successfully fought a worker’s compensation claim she’d filed under her married name, Miriam Engstrom. An insurance database turned up many fraudulent slip and falls, injuries, a stroke and accidents she’d filed claims for against four employers from 2001 to April 2003; insurers denied them.

Documents show she settled a slip-and-fall hernia case against Walmart for about $56,000 and got $8,000 for a 2001 motor vehicle claim. That insurer later found she’d had two other auto claims in 1998 and 1999, and had sought benefits for an alleged 1995 industrial accident — although she claimed to have only worked as a housekeeper and had no prior auto claims.

In the legal sense, real estate is any land along with improvements added to it such as houses, buildings, and other additions that cannot be moved—they are fixed. Real estate, in other words, is anything that has to do with a plot of land. If there is something built on that plot of land, that is included with it. Therefore, when someone is buying a house, what they are actually buying is that plot of land and everything that is included in the plot of land.

There are two main types of real estate property. The first is commercial real estate. This is any sort of real estate that is going to be used to generate funds or support a business. For example, a corporation might purchase an office building for their business. Just because they are not leasing it out doesn’t mean it is not commercial real estate because the property is being used to support their business. However, if someone were to lease the property, that would also be commercial real estate.

The other type of real estate property is residential property. These are places where people are going to live. For example, a residential property might be a single family house on a plot of land. Or, it could be an apartment within an apartment building. In other words, residential property is any type of property that has the purpose of housing an individual. There wouldn’t be businesses in residential property.

What is common, though, in big cities like New York City and Chicago is that they will combine residential property and commercial property in skyscrapers. For example, the first twenty floors of a skyscraper will be commercial property. The bottom floor will be store fronts and then offices for the next nineteen floors. After that, there will be apartments and suites above that. This is a developer’s way of diversifying the income coming in from the skyscraper to ensure profit is continuous.

Most of the time, a real estate broker is needed to deal with the buying and selling of real estate. This is a trained individual who is recognized by the specific state to handle all of these sorts of transactions. A commission is typically paid to this individual which is a percentage of the total sale. So, the broker might charge 3% and if the property sells for a million dollars, the broker walks away with a $30,000 commission.

In the end, real estate is something that nearly every person has heard of. It is a great way to make money if one is interested in investing, but more importantly than that, it is a great way to find a home. The recent economic crisis caused tremendous problems for the real estate market, but in previous months, the economy has begun to do better and with that, the price of homes and commercial buildings has begun going up as well. The housing crisis can’t have failed to get your notice in the media since the market crashed so spectacularly. Not only are homeowners going into bankruptcy, banks are too, with more than a couple of banking giants falling prey to the recession. Real estate has been hit hard until the market could protect it no longer.

Since the beginning of the financial crisis it’s estimated that real estate prices have fallen an average of 35%. Add to this job losses, investments crashing, retail prices increasing, and you have a melting pot of misery. The average homeowner has two choices if they can no longer pay the mortgage. Try a short sale or let the lender foreclose.

For the homeowner, the short sale was always the preferred option. It might take longer, but their credit score remains intact and they owe no more money. The foreclosure was quicker but ended up with the lender owning the home, and the former owner still owing the bank.

From the banks perspective, foreclosures were always the preferred option. They had to write off less money and were geared up to handle them. Banks were never really set up to handle short sales, which is why when the crisis first hit it used to take forever to get one approved. The lenders didn’t have the infrastructure to handle them, or the processes where employees could make decisions that would lose the business money.

Now the tide has turned and the lenders are preferring short sales. They now have, or are building the infrastructure to cope with the demand and are able to agree them much quicker.

This works in the banks favor because foreclosures used to lose them a lot of money. Not only on the defaulted loans but on the property itself. A foreclosed home is rarely left in a habitable condition, and a vacant property is notoriously difficult to sell for the real value. According to the Amherst Securities Group, losses on prime loans were 49% for a foreclosure and 34% for a short sale. Compare that to sub-prime loans where losses were 73% for a foreclosure and 59% for a short sale.

Those numbers tell you a lot as to why the lenders came round to the idea of the benefits of a short sale over a foreclosure. Now they have everything in place to process a short sale quickly, the tide has turned in its favor.

The lenders lose whichever method they choose, but with significantly less loss, and cheaper administration of a short sale it’s no wonder they choose it over a foreclosure. Not only do you have to factor property values into a foreclosure, it involves court time, lawyers and a whole host of other processes to see through.

For now at least, the short sale is king. The bank has to protect its assets, and for as long as a short sale is cheaper than a foreclosure, it wins the day.

Naples Home Builders Having a Hard Time with Chinese Drywall Problems

Home builders are having a difficult enough time as it is with the economic crisis and poor housing market. To then be faced with problems in work you have done, as well as trying to find work to do is a bit much.

This is the problem facing many Florida based construction firms because of defective imported drywall. During the housing boom of 2004/5 builders where busier than ever, as was the rest of the construction industry. This, combined with several hurricanes, including Katrina resulted in an unprecedented workload for construction companies. It also led to a shortfall in building materials as local producers struggles to keep up.

Many firms had to turn to imported materials in order to maintain momentum, and this is where the problems started. Drywall imported from China was used in thousands of properties across Florida, Louisiana and Alabama. Nothing was thought of it at the time, as construction firms were getting a steady supply of cheaper material, and the industry at large was given a breath as the shortage subsided.

It was only later, once the properties were constructed, and lived in for a while that problems began appearing. A smell like rotten eggs was soon being experienced by homeowners. Then came mysterious illnesses, without an obvious cause. Symptoms such as breathing difficulties, headaches, ear infections, eye irritations, and many other began appearing in households.

Eventually investigations led to the drywall, which in turn led to the imported drywall. It was found that it contained hydrogen sulfide among other things which gives off the rotten egg type smell. It is also attributed to various health issues, including the ones being experienced by homeowners. There are solutions for home owners who need to replace or repair the tainted drywall. Unfortunately it is a very costly process as all of the drywall usually needs to be ripped out and replaced with standard American drywall. Some of the companies offering this service are Chinese Drywall, China Drywall, and China Drywall Fixers.

Not only was this gas the cause of the smell, and allegedly the root of the health problems, it is also corrosive. Investigations into some of the affected homes found that it had corroded wiring, air conditioning and even new appliances. Copper is especially prone to corrosion and forms parts of many domestic appliances like washers and dryers. Studies found that in some cases, new appliances had experience catastrophic breakdown of the copper pipes causing them to fail.

The internal wiring of homes is also believed to be at risk as those that have been checked show signs of significant damage. In some cases the whole property has had to be completely rewired. Damage varies, depending on the extent of the work needed, and how much imported drywall was used. The material was used extensively in Florida over the period, perhaps in as many as one hundred thousand homes.

The true scale of the financial impact is as yet unknown.
