Justifiable use of deadly force, deputy cleared in fatal shooting

LEE COUNTY, Fla – No charges will be filed in a deputy involved shooting that occurred in May in Bonita Springs.? The State Attorney’s Office has finished its review of the case and concluded that the shooting was a justifiable use of deadly force.

On Sunday, May 16, 2010, at approximately 10:10 P.M., deputies with the Lee County Sheriff’s Office responded to The Inn at the Springs on Highland Woods Boulevard, Bonita Springs, in reference to a shooting.? When deputies arrived on scene they discovered a male victim suffering from a gunshot wound.? He was transported to a local hospital with non-life threatening injuries.

Due to the nature of the incident, detectives with the Lee County Sheriff’s Office Major?Crimes Unit assumed the investigation.? By speaking with the victim and witnesses on scene, detectives were able to determine the identification of the suspect.? Information obtained through the course of the investigation revealed the suspect may be at a home on? Morton Avenue in Bonita Springs.

Deputies responded to the home to see if the suspect was at the residence.? While investigators were on scene, the suspect approached the residence in his vehicle.? Deputies attempted a traffic stop but the suspect fled, leading to a brief pursuit.? While pursuing the suspect, deputies initiated a PIT maneuver and managed to disable the suspect vehicle.? When deputies approached the vehicle in an attempt to make an arrest, the suspect pulled out a firearm and was fatally wounded by deputies.? No officers were harmed during the incident.

The suspect was later identified as Craig Stephen Spitz.

‘Operation Medicine Cabinet’ this weekend

LEE COUNTY, Fla. – It’s time to gather up all of your unused or expired medication. The Lee County Sheriff’s Office is partnering with Florida Crime Prevention Association for “Operation Medicine Cabinet”, the latest installment of the Pharmaceutical Take Back Program. Three locations will be available to drop off your old, unused prescription and over the counter medications for proper disposal. Needles and other sharp objects cannot be accepted.

The following locations will accept your old medications on Saturday, November 13 from 10:00 am until 2:00 pm:

1) Coconut Point Mall in Estero in front of Hollywood Theaters (U.S. 41 between Corkscrew Road and Coconut Road).

2) Wal Mart Supercenter, 1619 Del Prado Blvd, Cape Coral.

3) Winn-Dixie, Sunshine Plaza, 1145 Homestead Rd North, Lehigh Acres.

Every day in the United States approximately 2,500 youths between the ages of 12 and 17 abuse prescription drugs for the first time. The Lee County Sheriff’s Office is taking a proactive stance in removing and properly disposing of unused medications. This can keep them from falling into the wrong hands and also prevent the drugs from being flushed down the toilet which poses an environmental danger.

Back in February, the Lee County Sheriff’s Office hosted a Prescription Clean-Out with the City of Bonita Springs which resulted in nearly 50,000 prescription and over the counter pills and liquids being turned in for proper disposal.

There is no cost to turn in your medications and all participants will remain anonymous.

The Lee County Sheriff’s Office discovered 76 counterfeit credit cards Wednesday while conducting a traffic stop on Interstate 75.

Deputies charged Juan A. Rodriguez, 52, and Joel Milian-Gonzalez, 35, each with 76 counts of felony possession of a counterfeit credit card one count of trafficking (10 or more) in counterfeit credit cards, two counts of possession of fraudulent driver’s licenses and one count of possession of a controlled substance without a prescription.

The men were arrested after a deputy with the Sherff’s Office’s Highway Interdiction Unit was patrolling I-75 in North Fort Myers and saw a Ford Taurus traveling too closely and with illegal window tint.

After stopping the car, the deputy noticed an odor of burnt marijuana coming from inside. A K-9 alerted to the presence of drugs in the vehicle.

After a search, the deputy found the credit cards, two fake driver licenses and three Furosemide pills.

A U.S. Secret Service agent confirmed the credit cards were fraudulent. Neither of the men had a prescription for the pills.

Construction manager reports cash stolen from truck

The manager of a San Carlos Park construction company said someone stole several thousand dollars from his truck Friday.

Juan Hernandez, 55, of Naples, the construction manager for Pavon Construction Co., 7513 Morgan Road, told Lee deputies he cashed a check at a Western Union check cashing kiosk inside the Sunoco convenience store, 10351 Corkscrew Road, Estero. He drove to a nearby Publix store at 20311 Ben Hill Griffin Parkway to purchase envelopes, according to a Lee County Sheriff’s Office report.

He left the cash in the envelope inside his 2000 Ford truck and when he came out 15 minutes later, the door lock was tampered with and the money was missing, according to the Sheriff’s Office report.

The deputy verified Hernandez had cashed the check just after noon and purchased the envelopes at 1:15 p.m.

The exact amount of the stolen money was not released.

? Kyle Lee Hodges, 18, of the 28000 block of Meadowlark Lane, Bonita Springs, was arrested Thursday by Lee deputies near the Sheriff’s Office Bonita Springs Substation, 8951 Bonita Beach Road. He was additionally charged with driving while license suspended. He is accused of hitting a car while intoxicated.

Battery arrests

? Julio Juan Andres, 23, who is listed under two addresses: the 26000 block of Sherwood Lane and the 26000 block of Horne Avenue, both in Bonita Springs, was arrested Thursday by Lee deputies in Lee County. He was charged with battery.

Man charged with firing gun during fight at Estero bar

A witness who saw a man shoot a gun into the air early Thursday outside an Estero bar and grill followed a car until deputies arrived, resulting in the arrest of the man.

Michael D. Mariathasan, 22, of the 15000 block of Ocean Walk Way, was charged with carrying a concealed weapon.

According to a Lee County Sheriff’s Office report:

At 1:43 a.m. deputies were called to the 21000 block of Stoneybrook Golf Boulevard in Estero about shots being fired from a weapon. The people were gone.

Meantime a suspicious vehicle call came in at 2 a.m. Cory Healey, 24, said he had been at the bar and grill when a fight broke out. He saw a man pull a gun, fired bullets into the air and ran past Healey, getting into a tan Nissan Altima.

Healey followed the car and two other cars until they pulled into a gasoline station at Daniels Parkway and South Cleveland Avenue.

Two other witnesses, a boy, 156, and Nick Pemberton, 26, confirmed Healey’s account of events.

The deputy saw the car driving north and followed it into the gas station parking lot.

The driver and passengers were asked to get out of the car.

Two guns, one loaded with four live shells and two spent casings, were found in the car. A check showed at least one of the guns may have been stolen in May 2009 from a Lehigh Acres house.

Lee County house fire death ruled homicide

LEE COUNTY, Fla. – A south Fort Myers house fire has now become a homicide investigation.

The Lee County Sheriff’s Office says the body of Ryan Vanderson, 34, was found along with the remains of a dog inside a home on Victoria Cove Court following a house fire Friday night.? Following an autopsy, the death has been ruled a homicide.

The cause of the fire still has not been determined.

He was charged with petty theft/second offense. He is accused of taking two shirts valued at $11.98 each, removing the price tags and putting them inside his other clothes.

? A red lawn chair was reported damaged when someone set fire to it Monday in the 19000 block of Skidmore Way in Fort Myers.

One dead in Lehigh Acres accident

LEHIGH ACRES, Fla. – The Lee County Sheriff’s Office says a person has died after a vehicle accident in a wooded area in Lehigh Acres.

It happened Sunday evening near Joel Blvd. And East 18th Street.? The Sheriff’s Office says it appears a person fell from a vehicle and was run over.? The victim was taken to Lehigh Regional Medical Center where that person was pronounced dead.

Drug arrests

Corey Perry Williams, 18, of the 19000 block of Ocala Road, Fort Myers, was arrested Thursday by Lee deputies at home. He was charged with possession of less than 20 grams of marijuana, possession of paraphernalia and on failing to appear on a violation of probation for driving without a valid license.

DUI arrests

? Alan Jack Biren, 61, of the 10000 block of Mirasol Drive, Fort Myers, was arrested Thursday by Lee deputies in Lee County.

? Erik L. Maritnez, 31, of the 27000 block of Pullen Avenue, Bonita Springs, was arrested Thursday by Lee deputies in Lee County.

Other arrests

? Angel Junior Pino, 19, of the 100 block of Osprey Landing, Naples, was arrested Thursday by Cape Coral police in Lee County. He was charged with aggravated assault with a deadly weapon without intent to kill.
